1. Introduction

Shocker Hitch is a leading provider of value-added towing products. We recognize that our success is tied to the success of our authorized dealers and resellers, who invest significant time and resources to deliver exceptional service and product expertise.

To protect that commitment—and to maintain the integrity and value of the Shocker Hitch brand—Shocker Hitch has established this Minimum Advertised Price (MAP) and Intellectual Property (IP) Policy.

This policy is a unilateral statement of Shocker Hitch’s rules regarding pricing and brand use. It is not a contract or agreement between Shocker Hitch and any reseller, nor does it require acceptance. Compliance, however, is a condition of being and remaining an Authorized Reseller.

The intent of this policy is to encourage fair competition, preserve brand value, and ensure that customers receive the highest standard of service and support from Authorized Shocker Hitch Resellers.

2. Policy Statement

Shocker Hitch, at its sole discretion, reserves the right to cancel orders, suspend shipments, restrict supply, or terminate business relationships with any reseller that advertises a Shocker Hitch product below its established Minimum Advertised Price (MAP).

This policy applies to all forms of public advertising and promotion, including but not limited to: websites, online marketplaces, digital and print ads, broadcast media, email campaigns, search engines, and social or display advertising.

Failure to comply with this MAP Policy may result in immediate enforcement actions up to and including permanent removal of Authorized Reseller status.

For Canadian sales, MAP is calculated as 1.6 × the U.S. MAP unless otherwise specified by Shocker Hitch in writing.

3. Guidelines

  1. MAP Reference
    The current Minimum Advertised Prices (MAP) for all Shocker Hitch products are listed on the official Shocker Hitch price list.
  2. Price Display
    • Resellers are not required to advertise a price.
    • If a price is shown in any advertisement, it must be at or above the current MAP.
    • Phrases implying a lower or negotiable price—such as “Call for Best Price,” “Lowest Price,” or “We Beat Any Price”—are not permitted.
    • “Call for Price” or “Request a Quote” is allowed only if no numeric price appears.
  3. Advertising Scope
    This MAP Policy applies to all forms of public advertising, including but not limited to:

    • Print media (magazines, newspapers, catalogs, mailers)
    • Broadcast media (TV, radio, podcasts)
    • Digital ads and emails, banner/display ads, paid search, remarketing, comparison-shopping engines
    • Social media posts with pricing
    • Websites, blogs, online listings, and dealer storefronts
    • Third-party platforms, affiliate sites, and any other promotional channels
  4. Reseller Pricing Freedom
    Resellers may set their actual selling prices at any level, provided that the advertised price remains at or above MAP.
  5. Promotions and Exceptions
    Shocker Hitch may, at its sole discretion, authorize temporary MAP exceptions for approved promotions.

    • Any authorized promotion will be announced in writing, specifying duration, products, and adjusted MAP.
    • Upon expiration, all resellers must immediately return to standard MAP pricing.
  6. Responsibility for Third Parties
    Resellers are responsible for ensuring that all affiliates, marketing partners, and third-party listings comply with this policy. Compliance cannot be delegated or disclaimed.

4. Shocker Hitch Intellectual Property

Shocker Hitch Intellectual Property:
Use by Reseller of Shocker Hitch Intellectual Property. Reseller agrees to conform to policy as set forth herein regarding the use of its intellectual property (“IP”). If Shocker Hitch does provide authorization to use Shocker Hitch IP, the authorized IP will not be altered from the original provided, or used in combination with any non-authorized material not related to Shocker Hitch to market Shocker Hitch products. Shocker Hitch IP includes but is not limited to trademarks, trade dress and copyrights in the images, text and slogans, Shocker Hitch uses to describe and market the Products, including but not limited to Shocker Hitch video, graphics, images, logos, designs, marketing materials and/or copyrighted print advertising. Shocker Hitches trademarks include the following, and are regularly updated at www.shockerhitch.com, all trademarks listed at this website are hereby Shocker Hitch’s “IP” and are hereby incorporated by reference: ® indicates that the trademark is registered at the US Patent and Trademark Office.

Authorized Dealers/Resellers may use Shocker Hitch IP or resell Shocker Hitch products in any of the following situations:

  • Magazines, newspapers & printed advertising
  • Television, radio, billboard
  • Resellers own website
  • Retail store
  • Trade show

Shocker Hitch IP cannot be used for any paid online advertising allowing a person to bid on any Shocker Hitch trademark as a search term entered by a visitor to a search engine site, along or in combination of other words, including by not limited to: Google Adwords, Bing Ads, Microsoft Ads, Yahoo/Bing/MSN Network.

Shocker Hitch IP cannot be used & shocker hitch products cannot be sold on online marketplaces, including but not limited to Amazon.com, Ebay.com, Google Product Search, Google Merchant Center, BestBuy.com, Shopzilla.com, Walmart.com, Target.com, Sears.com, Rakuten, Overstock, Newegg, Facebook Catalog, Facebook Store, Reddit Catalog, Instagram Catalog, Youtube, Snap Chat or Tiktok.

Shocker Hitch IP cannot be used & shocker hitch products cannot be sold on on 3rd party shopping sites including but not limited to google shopping, tiktok shop, instagram shop, reddit shop & facebook shop.

Shocker Hitch IP cannot be used for online display advertising, except on authorized resellers own website.

Shocker Hitch IP cannot be used on social networks site advertising platforms including but not limited to Facebook, Instagram, Google, Pinterest, Snapchat, Twitter, Reddit, Tiktok & Threads. Shocker Hitch IP can be used naturally (non-paid) on social media platforms.

Dealer/Reseller may use Shocker Hitch IP in the following situations:

  • When previously approved by Shocker Hitch per terms of this agreement.
  • May received internet search results displaying Shocker Hitch IP as the result of organic search results from the reseller/dealer web sites that have previously been approved by a Shocker Hitch officer.
  • May use Shocker Hitch trademarks in the reseller/dealer website product description content, if and only if that product is offered for sale by the reseller/dealer under the conditions of this agreement.

Shocker Hitch, LLC will provide authorized images and text for Shocker Hitch approved uses upon request of dealers/resellers who are in good standing. Images and text may not be redistributed to others without prior written consent, in writing by a Shocker Hitch, LLC. officer.

Failure to comply with Shocker Hitch IP policy: Any unauthorized use of Shocker Hitch IP is a material breach of this agreement and may result in loss of discounts, institution of legal action and refusal to supply reseller/dealer with any further Shocker Hitch product.

5. Pricing Statements

  1. Optional Price Display
    Resellers may choose to omit pricing from advertisements entirely. Any advertisement that includes a price must comply with this policy.
  2. Prohibited Wording
    The following (or similar) phrases are not permitted: “Call for Best Price,” “Call for Deal,” “Lowest Price Guaranteed,” “We Beat Any Price,” “Name Your Price.”
  3. Permitted Promotional Language
    Generic phrases such as “Great Value,” “Premium Quality,” or “Smooth Safe Towing Experts” are allowed. “Call for Price” or “Request a Quote” may be used only if no numeric price appears.
  4. Non-Price Promotions
    Free shipping, 0% sales tax, free financing, or loyalty/rewards incentives do not violate MAP if the advertised price remains at or above MAP.
  5. Price Matching Policies
    Price-matching policies may exist internally but cannot justify advertising below MAP. All advertised prices must remain at or above MAP.

6. Failure to Comply / Enforcement

Shocker Hitch reserves the right, in its sole discretion, to enforce this MAP & IP Policy through the following actions. Enforcement decisions are final and not subject to appeal or negotiation.

  1. General Authority
    Shocker Hitch may cancel orders, suspend shipments, revoke discounts, restrict access to new products, or terminate the reseller relationship for non-compliance.
  2. Distributor Responsibility
    Distributors must ensure all downstream dealers have signed or acknowledged the MAP & IP Policy. Selling to unauthorized resellers is a violation.
  3. Corrective Timeline
    Violations must be corrected within 24 hours of written notice. Failure to do so may result in account suspension or termination.
  4. Violation Escalation
    • First Violation: Temporary account hold + written warning. Correct within 24 hours; 30 days of compliance clears record.
    • Second Violation: 30-day account suspension pending review.
    • Third Violation: Permanent termination of Authorized Reseller status and purchasing privileges.
  5. Unauthorized Resellers
    Any dealer selling Shocker Hitch products without an acknowledged policy is unauthorized. Authorized distributors must not supply them under any circumstances.

7. MAP & IP Policy Confirmation Acknowledgment

This Shocker Hitch MAP & IP Policy Confirmation Acknowledgment is between Shocker Hitch, LLC and the undersigned Authorized Dealer/Reseller.

By signing below—or by submitting acknowledgment through the online Become a Dealer form—the reseller acknowledges receipt, review, and understanding of this policy.

This acknowledgment does not constitute a bilateral agreement. Compliance is a unilateral condition of maintaining Authorized Reseller status and eligibility to purchase or advertise Shocker Hitch products.

Shocker Hitch may modify or terminate this policy at any time. Updates will be communicated in writing or posted at shockerhitch.com.
